Re: The Lawsuits Thread
Just me speculating
Whatever happened to:
1. Plaintiff’s Motion to Use Prior Depositions
To be heard Dec 13
2. Defendant’s Motion to Strike Plaintiff’s Expert Disclosures.
That was to be heard today but his name was not on the Friday motion docket list. I’m guessing since the trial date was moved he is no longer late. I guess motion on bifurcation will be rescheduled.
Are prior depositions by the Police Department considered “expert disclosures” as well?
No
3. Have 1 and 2 somehow been merged into one??
I don’t know. Good question
4. The Bifurcation Praecipe and the Expert Disclosures issue - SEE ABOVE
5. I still have the Demurrer Dismissal and Plea in Bar scheduled for Friday, December 20th, BUT doesn’t all that other stuff have to be resolved first?
The demurrer is scheduled for Dec 20. If they find for Depp then the will schedule or AH will motion for a Plea in Bar as Depp wants a jury. If they find the demurrer for AH I guess it may get dismissed
Is there a new calendar somewhere available to the public?
Fairfax doesnt Have a running calendar list on the case website like LA Court does. I think there is allot going on we don’t know about. Chew said AH filed 31 subpoenas.
6. Samantha Spector
Anything AH discussed with Spector is privileged. But I wonder anyone else she talked with like Drew and Raquel is up for grabs

Re: The Lawsuits Thread
Thanks so much, Lbock.
Sorry for not reading your earlier replies closely enough. Actually, I’m relieved to see your comment on the Judge’s (I presume) warning to the parties “not to spin it.” A bit light and late, but out there now. If ever there was an attorney who deserves the moniker “spinmeister” it’s Kaplan. Could this definition be anymore on the money when describing her “legal expertise”?
Definition of spin ( a story) ): to tell a lie or only part of the truth in order to convince one of
something or to avoid the consequences of something
Hope Johnny is doing ok.
Going to be a rough two weeks to weather.

Re: The Lawsuits Thread
Brian McPherson released her opposition to the earlier police depositions. So what Johnny Depp’s attorney Wasser said was true. Her TRO was intended for financial gain not that she was actually abused. Once she knew she was getting money she was no longer Interested in proving her alleged abuse hoax

Let' s not forget the extortion letter that was sent from the ex's lawyer to his lawyer saying she was willing to settle "all matters" if he gave into her ridiculous demands. He said no and THEN she filed the dv charge. Also, Her pictures have no date and time stamps and she never turned over the digital photos. Wasser fails to mention that it was only a temporary TRO and anyone can get one.
Nice try but no cigar.
She has no real evidence or witnesses.

Re: The Lawsuits Thread
Agreed! But that's unfortunately not what the media is focusing on ...
And much as it is important for Johnny to win in court; to literally prove what happened, it doesn't help much, if the media sticks firmly to the mantra "All women, who say, they have been abused, must be believed" - unconditionally without checking the characters of the two persons involved, or, Heaven forbid, the evidence
Ouch

Re: The Lawsuits Thread
Depps opposition to demurrer and Plea in bar looks sound. Note AH team seems to be limiting their Plea in Bar to statue of limitations on the abuse claim. I’m thinking they did this to avoid a jury Plea in Bar. The bench can rule on that, IMO

Thanks, Lbock.
Trying very hard not to overthink anything at this point. Trying especially hard to control my overwhelming anger and sadness, an unhealthy (not to mention less than helpful) combination for sure. And hoping beyond hope, the powers that be see to it that it is a very happy and relieved Johnny on stage with Alice on Saturday, the 14th . . .

Re: The Lawsuits Thread
I want this mess to be over for Johnny's sake. But hopefully it will set a precedent regarding spousal abuse suffered by men. Johnny's been incredibly brave coming out with this, rather than simply denying that he was the abuser.meeps wrote: ↑Sun Dec 08, 2019 7:24 amAgreed! And Heard needs to be prosecuted for blackmail. How dare she make false allegations of abuse purely to get an undeserved divorce settlement. Worse, Johnny is known for his generosity. He gave Vanessa a substantial sum after their split despite her never asking for anything.

Re: The Lawsuits Thread
I am sure Johnny and his team were aware that she would try to get lawyers to use every under handed trick they can (including smear campaigns) to avoid her in actually filing a real response to the complaint where she would have to admit or deny that the article was about him. Well she can't deny it now that she is doing motion after motion and subpoenas trying to prove he was abusive.

Johnny Depp Scores Legal Victory, Allowed Use Of Police Testimony Amber Heard Had No Visible Injuries

Johnny Depp has been granted the right to use testimony of two LAPD officers who claim Amber Heard had no visible injuries on the night she alleges she was the victim of domestic violence.
According to new legal documents, obtained by The Blast, the judge is Johnny Depp's defamation case against Amber Heard granted his motion to use deposition testimony of the two officers who responded to the ex-couples home on the night of the incident.
Both officers testified under oath they did not see any injuries to Amber's face when they first encountered the 'Aquaman' star on the night of May 21, 2016.
LAPD Officer Testifies She Saw No Injuries To Amber's Face
As we reported, on the night in question, Amber Heard claims Johnny Depp hurled a cell phone at her that struck her in the face. Amber filed pictures of the marks on her face, as a part of her restraining order against Depp.
But, an LAPD officer who was first on the scene, says she did not see any bruising or marks on Amber's cheek while interviewing her about the alleged assault.
In a deposition, taken by Johnny's attorney, LAPD officer Melissa Saenz answered questions about Amber's injuries...
Q: Did you see any marks of any kind on her face at all? A: No, I did not. Q: Did you see any signs of swelling or injury to her face at all? A: No, I did not. Q: Okay, did you see any bruises or marks under either eye? A: No, I did not. Q: Did you see any bruising or marks on either of her cheeks? A: No, I did not."
Second Officer Testifies He Saw No Visible Injuries
The other officer who arrived at the ex-couples home, LAPD officer Tyler Hadden answered questioning about possible injuries to Amber saying, "But just from her passing, I could see her, and what I saw was just a red face. She was in tears crying and that's all that I observed. Again, my partner spoke with her. And towards -- before we left the location, we both spoke with her.· And neither time did I see any type of injury.
According to the deposition, obtained by The Blast, Officer Hadden answered questions directly about the injuries to Heard's face.
Q: Did you see -- as she walked by you, did you see any swelling of any kind on her face? A: No, I did not. Q: Okay, Did you see any marks of any kind on her face? A: No, I did not. Q: Any indication of bruising on her face? A: No. Q: Any indication of any sign whatsoever of any injury to her face? A: No.
Officers Testimony Filed In Depp vs. Heard Case
Johnny Depp's legal team filed a motion to use the depositions to prove it's position that Amber Heard made up allegations of domestic violence. But, Heard's legal team fired back saying the officers were not properly cross-examined during the depos and shown evidence of Amber's injuries and other evidence.
In a letter to the court, obtained by The Blast, Johnny Depp's attorney said, "The testimony of these officers of the Los Angeles Police Department, for which Ms. Heard's counsel were present, and which Ms. Heard now seeks to suppress -- couple with security camera videos from the Eastern Columbia Building where Mr. Depp and Ms. Heard were living contradict Ms. Heard's claims that she had marks on her face on the night of, and in the days after, the alleged assault. The officers also testified that they made security sweeps of the penthouses and found no signs of the massive property damage she alleged took place that night."
Johnny Depp's Lawyer Says Either Cops Are Lying Or Heard Is...
Depp's lawyer, Adam Waldman tells The Blast, “It’s not complicated - either two domestic abuse-trained police officers are lying, or Amber Heard and her co-conspirators engaged in an abuse hoax. Ms. Heard and her friends testified that her face was smashed and the crime scene was carnage."
He continued, "Yet both responding police officers, including a female officer who has answered more than 100 domestic abuse calls, testified that after conducting two face to face interviews with Heard and two security sweeps of the premises, both Heard’s face and the penthouse were unmarked. Which is the same thing 87 surveillance videos, over 30 separate sworn eyewitnesses, and two other responding police show.”

Re: The Lawsuits Thread
Johnny's motion was granted and her opposition was DENIED.
However they can still take the depositions of the officers which I don't think will change any of the facts from their testimony but this is a good win.
