The texts were not disclosed BUT The Sun did have access to them. His team did violate the order but not enough for the case to be dismissed. It seems the Judge is allowing them to be sanctioned and then it will still proceed with trial.

The msm and tabloids, alike, will forever talk about this as “Johnny Depp’s (not his lawyers’ ) failure to supply the opposition with ...”!

What is going on with Johnny’s US/VA legal team? After that first unforgivable “wrong-button-push” that sent tens of thousands of documents to the opposition in error, one would expect everyone on Johnny’s legal teams - on both sides of the pond - would be checking, double checking, AND triple checking at this point to ensure every single request was submitted to the requesting party and received. And receipt confirmed. At this level of expertise there should be no possibility for something like this to even raise its ugly head much less now to have morphed into the potential death knell to Johnny’s case.

Extremely complicated case? Yes, no kidding. Extremely talented attorneys presenting Johnny’s case? Supposedly. I hope Mr. Justice Nicol was not put off by Mr. Sherborne’s seeming strategical intransigence:

All the more reason to expect the merits of the case to carry the day, this day anyway, for the trial to go forward, not for justice to go down in flames on a technicality. And THAT is Mr. Waldman’s water to carry in VA and Mr. Sherborne’s in the U.K.

The judge is allowing JD to apply for sanctions. If he grants the sanctions, the trial will happen. He probably will or else he would have dismissed the case right off the bat.

I think that maybe JD's team didn't produce the texts on purpose and they knew it wouldn't be enough to dismiss the case. Getting sanctioned doesn't look good but neither do those texts so they went with the hopes The Sun wouldn't notice the missing texts, imo.

Some quite interesting points in here the most awful from the Sun's barrister saying that if JD is entitled to public vindication he can get it in the case against AH in the US. Wow that's self serving - Sun can write what it wants about who it wants if they can go somewhere else and get vindication.

It just seems like the Sun is throwing everything including the kitchen sink at trying to get a dismissal.

Seems like the biggest disclosure problem they have is from their star witness.

My guess is that the Sun will continue everything to try and get a dismissal on a technicality right up to and including during the trial itself - if indeed it goes ahead.

Still waiting for the posting of the Judge's order from Friday re: JD's motion for AH to sign the HIPAA release for him to get all her medical records. Her team responded to the motion but I don't see a reply from his team. It's possible it didn't hit the system yet.

Hi, I was on the call, up at 4:30 am and it didn't finish until after 3pm

It was scare in the beginning. NGN was making such strong points, but Sherboren came on strong in the end. So fingers crossed

Can anyone watch this if they have skype? Other than being in 1 of the 5 courtrooms, how are people listening to this, because I'd like to do so tomorrow or whenever no matter how early I have to get up (West Coast US)?

I see Lbock was also following. Any other places recommended besides the news reports?

I don't know if there will be any more hearings. Judge said this is the last and I don't know if the court trial itself will be skyped

A journalist there remarked that the judge was frustrated at the beginning because he couldn't hear what people were saying. He left for a few mnutes with the barristers. After they returned, a court assistant showed the judge where he could adjust the volume on his computer/headset. Not laughing at him - sounds like a problem I'd have. The fewer of these skype sessions the better for Nicols J, I'm sure.

Ran across this trial tidbit by NBC news CT:
At the High Court on Monday, Sherborne said Heard's claims were undermined by the fact that she had had affairs with Space X founder Musk and actor James Franco while she was involved with Depp.

“Given that her case is that she was controlled and abused by the claimant and that she could not possibly have left him, that does not sit at all with the fact that she was having multiple affairs," the lawyer said.
