So I remember a while ago watching Andrea Burkhart discussing the counter claim on a YouTube video and saying that the problem with it for AH is that it puts as much of a burden of proof on her as it does on JD. Andrea described it as a mistake on AH's party.

I know we all hate seeing rulings go against him - mainly because the media writes it up as if it is such a big loss he must be guilty - but this is just part of the to-and-fro in the lead up.

With regard to anti-SLAPP defence, she has to prove she was truthful. Far too much has been said by her own side including Elaine - showing that it was about him. Whatever one thinks of Roberta Kaplan, she did put up a reasonably argued case that AH was just giving an opinion regarding her experience after making allegations (not anything else).

Kaplan lost that argument and the case went ahead but there was nothing to stop AH continuing to say that.

But now instead we've gone from Kaplan saying "anyone with a basic grasp of English could see if was nothing to do with him" to her side being forced to show correspondence that it was all about him.

All of those emails are going to come out. That entire chain between her and Eric George and the ACLU will all be shared with the jury.

So that means her only option if she is relying on an anti-SLAPP defence is to PROVE she was speaking the truth about him.

That is what Judge Penny is allowing her to do.

Please someone correct me if I have this wrong, but pretty sure that's correct.

Ok glad it made sense, I wasn't sure I was explaining myself well.

I believe what Ben and team will say as their narrative is:

- AH knew she was not abused - and here is the evidence to show she was not;
- Knowing this she went ahead and wrote an article which we can prove was about him - here are the emails and statements by her lawyers saying it was about him;
- Further, when caught out she fabricated evidence or lied about events - faked photos, body cam etc;
- And just in case you want to give her the benefit of the doubt, she lied multiple times including in court documents - and she didn't give that money to charity.


As a side note - I do hope that Ben and co are going to bring up developments between the divorce and original allegations, and her publishing the article. Anyone remember summer 2016 and 2017? Johnny actually had a fantastic year. People's Choice Award. Over a billion at the box office. No 1 perfume. New franchise and a slew of other new projects.

I have always harboured a feeling that she did this because she could not let him continue his success without her.

I've always thought that she sat at home watching him getting the People's Choice Award, walking the red carpet in Shanghai etc - and realising (1) she wasn't bathing in his publicity any more (2) she seethed with jealousy.

Point being, in 2017, Johnny's career was still doing really well. Then she dropped the article.

I just read Johnnys recent filing for sanctions against AH. Her team did not comply with the court order (8. November 2021) concerning the IT expert.
I guess AHs team used the stonewalling tactic, combined with a "bury-them-in-paperwork" tactic the sooner we get to the trial date.
So I hope there will be sanctions! Can't deny the fear JD might get no justice is sneaking up on me with all the decisions against him yesterday.

I further hope the expert will have enough time to analyse the pictures and prove that they have tampered metadata. Beside her "witnesses" its the only thing which technically could prove her abuse claims. (We know there are no medical records...).
And I think its easier to convince a jury with the truth about a picture, than prove that a witness is lying. This approach somehow failed in the UK trial.

I am sure Mrs Zellner is still on this case. It would not be a smart decision to announce it on social media only to wave the case goodbye eight weeks later.

I never understood Zellner coming in so late. I think too many cooks in the kitchen. Ben is lead attorney.

Maybe she is/was only an advisor. I also saw an opinion she was on board maybe to be ready for an appeal.

Maybe you are right about Mrs. Zellner advising. Or, she is a detail oriented law-wizard, otherwise its not possible to dive that deep into the case this late I guess. Its very complex.
Maybe she advises on the legal strategy with Adam who will run the PR side and Ben+team will do the hard labour.

I think she might be in to do the cross examination of AH and perhaps other female witnesses (are there any left??) Bad look for a male lawyer to hammer questions at a women - it's why Sherbornne didn't do the cross examination of AH in London.

I've only just go to the bit of Making A Murdered where KZ comes in - what I loved and thought was very relevant is her saying that it is no good saying what didn't happened - you have to explain to people what did happen.

On the forensics/photos- we knew she would do something like this. I am surprised she handed over anything - in the UK we've had a case between two footballers wives, and the publicist for one of them lost her mobile phone when it slipped out of her hand whilst she was on a fishing trip in the North Sea. Seriously.

So, by using the SLAAP defense and saying the article was, in fact, written about him, then she will show she is a liar for denying the claims in the first place because she can't have it both ways.

JD is in LA meeting with his lawyers and she is doing a low budget film in another country. :smh: :facepalm: :dunce:

I guess they want to show everyone that Johnny and his movies got bad reviews before HER article destroyed his career? :spin:

So are they giving up on the DV angle and just saying she didn't cause his Hollywood cancellation? Therefore, she's not guilty of defamation? :perplexed2:

I don't see "City of Lies", "The Barbarians" or "Minamata" on the list. I see pics from him receiving awards recently, but no mention of his honors. Just his failures. Hope she list all of hers as well.

Yes. Truth & Justice. I certainly am extremely thrilled that LauraB posted here as well. Unfortunately, Twitter, is becoming very toxic. We need facts not attitudes.
