By the way, Deadline had an article talking about an actor joining Aquaman 2 and I find it very interesting that she is not named anywhere in the article. It just says "said actor joins Jason Momoa in sequel", "Jason Momoa set to reprise his role." Intriguing no? ;-)

EXCLUSIVE: Johnny Depp says new police testimony and never-before-seen bodycam footage showing a tidy apartment PROVES Amber Heard is lying about blowout fight where she claimed the actor trashed their penthouse and threw a phone at her face

dailymail.com

Article by Ben Ashford
16th April 2021

Johnny Depp says new police testimony and never-before-seen bodycam footage 'proves' Amber Heard is lying about the blowout fight that ended their toxic 18-month marriage.

Heard and her allies have given evidence in multiple legal cases saying Depp hurled a phone at her face and trashed their penthouse kitchen during the notorious May 2016 dust-up. But the actor's lawyers claim the lurid depictions of damage - including broken candelabras, glass strewn on the floor and red wine sloshed on the walls and carpets - are completely at odds with what police remember.

Four different LAPD officers visited the stylish, loft-style apartment in downtown Los Angeles within the space of two hours after Heard's pals mistakenly dialed 911 twice.

The first two cops have given new depositions within the past month reiterating that they swept the $1.5 million property but didn't see any injuries, vandalism or evidence of a crime.

DailyMail.com can also reveal for the first time footage from a second set of responding officers who had cameras on as they entered Heard and Depp's former marital home later that night. The officers don't appear to spot anything suspicious, however, and there are no obvious signs of damage, disarray or staining to the floors or carpets in the three and a half minute videos. Their body-worn devices reveal a tidy hallway leading to an elegant kitchen and living area adorned with ornaments, fresh flowers, piles of books, numerous candles and candelabras.

Depp's attorney Adam Waldman says the footage proves there was never any wrecking spree and that Heard's account of the evening cannot be trusted.

'Amber Heard and her friends described a chaotic, messy crime scene but the newly released LAPD bodycam videos unambiguously show that the penthouse was utterly undamaged and that their testimony was one more grandiose lie,' Waldman told DailyMail.com in a statement.

The former couple are preparing to square off again in Fairfax County, Virginia, where Depp is suing his 34-year-old ex-wife for $50 million over a Washington Post op-ed in which she described herself as a domestic violence survivor.

The December 2018 article did not mention him by name but Depp, 57, claims he was booted from the lucrative role of Captain Jack Sparrow after the 'hoax' account led to speculation he was the abuser.

The Pirates of the Caribbean actor is fighting an uphill battle to salvage his reputation after Britain's High Court rejected a separate defamation claim last year over a 2018 article in The Sun newspaper that labeled him a 'wife beater'.

Justice Nicol ruled that the depiction was 'substantially true' and that father-of-two Depp had attacked Heard a dozen times, causing her to fear for her life on three occasions.

The May 21, 2016 incident was included in the catalogue of abuse after Heard gave graphic testimony describing how her former beau hurled a phone in her face and tore out clumps of her hair.

The confrontation was said to have taken place inside penthouse 3 of the swank Eastern Columbia building, where Depp once owned an entire floor of five neighboring apartments, accessed via a private elevator.

After Depp's security team broke up the fight he went into penthouse 5, where Heard kept some of her stuff, to 'ransack' her possessions and cause further damage before finally leaving the building, it was claimed.

The Aquaman star's lawyers provided the court with time-stamped 'crime scene' images, including smashed photo frames, broken glass and wine spilled across hardwood floor and carpets.

Heard and her best friend Rocky Pennington, an eyewitness to the alleged assault, offered previous accounts of the dust-up in depositions for her 2016 divorce from Depp.

'They have a big kitchen island in the middle of the kitchen and on there, there's candles and like fruit and, you know, glass, like jars and vases and things like that,' Pennington said.

'And he just was hitting everything with the wine bottle, just smashing it all off. So there was fruit on the floor and baskets and, you know, glass bottles and flowers.'

In her own deposition Heard added: 'We have huge heavy silver candlesticks, candelabra sticks. Those were on the floor broken. Baskets of fruit that we had on the kitchen island.

'There … fruit everywhere. Baskets on the ground. The containers holding the spoons and forks, kitchen utensils, those were spilled.'

She added: 'He broke a lot of glass things that left glass on the floor … when he walked out into the hallway, you could see wine spilled all over the ground and wine on the walls and … and so I knew that at least he had gone through there and was like sloshing wine anywhere.'

The LAPD cops who responded to two separate 911 calls that night paint a very different picture, however.

First on the scene around 15 minutes after the alleged assault were Tyler Hadden and Melissa Saenz, a domestic violence specialist, who say they swept both apartments but didn't see any injuries to Heard's face or evidence of vandalism.

The pair have given sworn testimony about the incident on three occasions now; during the couple's 2016 divorce; at last year's UK libel trial; and during fresh depositions in March.

'I did not identify her as a victim of domestic violence,' Saenz told Heard's attorney Elaine Bredehoft last month.

'We met with the victim, we checked the location, the husband wasn't there, and that the victim advised us she wasn't going to give us further information.'

Asked by Depp's attorney, Leo Presiado, if she remembered spotting anything resembling the damage depicted in Heard's photos during her protective sweep, Saenz replied: 'I did not.'

Hadden was similarly asked if he recalled any signs of vandalism, property damage or spilled wine. 'Not that I can recall,' he replied.

Neither Saenz or Hadden were wearing cameras as the devices were still being phased in by the LAPD and, as the UK judge noted, neither took down any written notes.

But the second set of officers, whose names have not been made public, both had cameras on when they arrived two hours after the fight.

Their three-minute clips obtained by DailyMail.com show the two male officers walking along a well-lit hallway before Pennington's husband, Josh Drew, answers the door to penthouse 3.

He offers to get Saenz's business card for them but they push the door open, saying they 'just want to make sure everybody's ok.'

The two cops are seen walking through a hallway and kitchen towards an open plan living area where there are three women sat on a couch and two small dogs scampering about.

The apartment is dimly lit but the footage captures tables and sideboards topped with an assortment of picture frames, ornaments, stacks of books and a large bottle of wine.

There are more candles, candelabras and a vase of flowers on top of the kitchen island but nothing appears to have been damaged or knocked over.

There are no obvious stains or puddles on the Persian rugs inside the property or on the walls or carpets in the corridor separating Depp's various homes, which he has since sold.

'The other officers came by and checked the apartment and other apartment as well,' says one of three women sat on a couch. 'It must have been like a double call.'

When the officer asks 'who's Amber?' another female silently raises her hand. They tell the officers that 'Johnny' left the property two hours earlier.

A cop casually asks 'everything's all good then?' When a woman responds 'now it is, yes, thank you' they turn and leave, having been there for a minute and a half.

In his 2019 deposition for the Virginia case Drew refers to cleaning up broken glass in the approximate hour and 45 minutes between the two police visits. However he says he did nothing to clean up the wine.

'After the first officers we did clean up the broken glass off the floor … the dogs were there and just for safety's sake,' Drew said.

'In Penthouse 3 there was a number of broken glass and items strewn about the counters and the floor in the kitchen. Only in the kitchen. It was sort of around the kitchen island.

'In the hallway, outside of the penthouse, was quite a bit of spilled wine. I don't believe we dealt with that at all.'

In previous evidence for Heard's divorce Drew described a 'gigantic wine stain throughout the entire hallway' – something that Waldman says it would have been impossible for two sets of cops to miss.

He added: 'You can see clearly in the police bodycam videos that all the items Ms. Heard and her friends claimed Mr. Depp smashed to smithereens with a wine bottle off the island in his penthouse kitchen – glass, fruit, baskets, vases and candelabras – are in perfect condition and tidily in their place.

'Nor does the red wine they claimed that Mr. Depp splashed all over the light-colored hallway carpets and walls exist. These videos prove unambiguously that the first two police officers on the scene told the truth about no damage.

'It is not complicated: Ms. Heard and her confederates lied.'

Depp and Heard met on the set of The Rum Diary back in 2011 and married four years later before their May 2016 fight proved the final nail in their chaotic union. They agreed to a $7million divorce settlement in August of that year however their feud reignited in 2019 when Depp sued over the Washington Post op-ed.

Heard responded by countersuing for $100million, cataloging the years of alleged abuse she suffered at the hands of 'the monster' in a lurid 300-page filing.

She also appeared as the star witness in last year's UK libel trial to testify on behalf of The Sun about 14 incidents of domestic abuse, 12 of which were accepted by the judge.

Depp was refused leave to appeal last month on the grounds he received a 'full and fair trial' and was ordered to pay $840,000 in legal costs.

Friends say he is determined to fight on and won't contemplate settling the upcoming Virginia case, which has been repeatedly pushed back because of the Coronavirus pandemic.

In the meantime Heard's legal team has asked the judge to toss the case, arguing Depp's arguments were discredited in the London proceedings.

Woo once again I was completely wrong - body cams and the footage has been kept all this time. Woo hoo. Its a shame it wasn't available in the UK trial not because it would have made any difference but it would have been interesting to see how the judge would have dismissed it. "Whilst the footage showed no damage I nonetheless believe Ms Heard."

So can one of you help me understand the time line. They must have sloshed the wine and moved a couple of pictures after the second set of police had been and gone? Was there metadata on the photographs which they showed? Because if the photos can be timed to after the police visit they are in serious trouble. Faking a crime scene?

That sweeping shot of the corridor is amazing - and no, sorry AH, as someone who has spilt wine on more than one occasion, I can tell you can see where it has been cleaned and scrubbed and is drying for hours afterwards.

She'll say no doubt that those are other flowers and things but seriously ...... the wine may be the undoing.

So Josh Drew along with Raquel have really, really put themselves into the middle of a perjury complaint here.

:biglaugh: :harhar: :rotflmao: This made my day.

But I think we all know this means more subpoenas and motions. Her and her team are so predictable, they're really getting boring.

Still, it's so great to see her exposed. :snoopydances:

She has filed some more in Fairfax. Of course opposes Ben’s amount of money he charges

She also filed a supplement to her Plea in Bar. I am not a lawyer at all, but it scares me how strong it reads to me. I’ve sent it to Andrea and Katherine for their input
https://www.fairfaxcounty.gov/circuit/s ... 3-2021.pdf

Update. Andrea answered me

Nope, I guarantee it's not. Even from a quick read through, the giveaway is how she never sets out the elements. It's her burden to establish these doctrines fit the facts of the case, but she's not even going to say what the test is? Uh uh. Seriously, Ben's response is gonna go 💥

The unimaginable complexity of this case - despite the frustrating need to present a straightforward, logical argument at every juncture - must not be diluted in the effort to bring to light the equally complex and unimaginable, totally life altering hoax perpetrated upon an innocent, decent man.

Yes, hoax. A word that evokes notions of dark conspiracies, thriller novels, and the like - not real life considerations. But, again, I say, “Yes, hoax.” A shape-shifting plot, with varying, amoral and/or powerful antagonists and greed-riddled wannabees emerging, fading, and re-emerging literally over an astounding time frame of years and from an incredible expanse of geo-political landscape. Each with varying degrees of skin in the game.

AH’s “new” motions are demanding dismissal of Johnny’s VA defamation lawsuit against HER (as opposed to his UK libel suit against the cowardly, corrupt NGN/Wootton/Murdoch trifecta). Yet, in these motions, she inexcusably indulges - and, to my mind, is being indulged - in still more wheel-spinning and despicable selective judgement-referencing while desperately trying to equate two virtually anti-thetical civil justice systems. Could not the new VA judge have tossed this motion upon receipt and thus set a different tone for what is going to be tolerated going forward? Not in this lifetime I suppose...

What am I ultimately ranting on about? I am afraid.

A fear rooted in ignorance. A fear rooted in unmitigated astonishment at the depths of base corruption in the once-revered British court system. A fear rooted in an inability to now let go and trust the U.S. justice system and the newly appointed judge - the latter, in particular - to have read the High Court judgement and Johnny’s request for permission to appeal, in entirety, for herself; did she - we will know when she rules on this motion to dismiss. A fear rooted, too long, in disappointment with Johnny’s legal team for failure to counter fire with fire, to rattle the opposition to their core and to give life to “#Justice for Johnny Depp”. A fear rooted in worry for Johnny - his health, his peace of mind, his “space” - no matter how humble - being continually tainted by the oath of those who, whether insidiously or overtly, remain determined to destroy him and to thwart his desire to challenge his creative spirit on any level commensurate with his proven talents. I am afraid there is no end to what has been put in play.

Isn't it basically normal that the defendant files that this is all nothing and they have nothing against me so it all should be ignored, in a case? It is basically a ploy to the public that this is all nothing and they have nothing on me. Just last week the lawyer did this in the trial of the police officer who kneeled on George Floyds neck until he died...after the prosecution presented a boatload of evidence that the police officer is guilty. He basically told the Judge that the prosecution had not proved its case - the Judge shut him down.

It does seem early for her to do this - but public opinion is going against her - so why not try to fool everyone into thinking Johnny has no evidence?...Like that would work :spin:

Her new motion for dismissal was inevitable. The defamation case in the VA is against her. The UK trial was against Murdoch / Wooten / the Sun. AH was only a witness. Nicol was impressed with the breast and the vagina, and most of the time she was going braless, as was her sister, Whitney. There are so many red flags. In the British system of justice you have the "good old boy network" with antiquated laws and standards. They're "stiff upper lip" does not approve of JD's sense of humor, drinking, and drug-taking. Even though I am sure that there are Judges who can get totally plowed, and it's just covered up.

Do we know if the new judge or judge White will be handling the ruling? I think we must wait for the answer. We are all scared. We can't change the UK system. In the VA trial there will be 12 jurors - there will be a lot more new evidence mostly on JD side. A H & Company they are running scared. 1) she moved to Yucca Valley; 2) to a home that is in a trust in which JD cannot take from her; 3) evidence the LAPD body cams strongly support JD and the defense is flipping out.

The language used in the new motion shows that they are questioning the monies owed - probably because she has so little money left to pay her bills. The money that was supposed to be paid to the ACLU and the CHLA wasn't paid. She has a lot of explaining to do. They complained about JD spending $30,000 a month on wine. Really? Have you noticed how much AH and her freeloading friends drank? I bet there's a good chunk of the $30,000 right there. Take solace and knowing that after the release of the film footage from The Daily Mail and the LAPD body cams showing Josh, Rocky, and the nameless one and their false statements. I am sure by now that Dan Wooten and Justice Nicol are now joining the ranks of the nameless one as they have probably poihed their beds.

That is enough of a personal summary, from my point of view. Let us keep our chins up and look towards the horizon. JD will have his justice - it's just very slow in getting here. Love to all.

Adam teased the body cam - I scoffed and said nonsense, not after all this time, plus she asked for it so must already know it isn't available, plus surely even if it is it will be too grainy to be of any use - and hey presto, the body cam comes out, showing lovely hallways totally clear of wine stains.

Heard stans immediately jump up and down and say ah yes, but they cleaned up before the second set of cops came (in contradiction of the hoaxers own evidence mark you, remember they didn't clean the wine).

I think Adam has got some more for us. He's now alluding to a computer guy coming to pick up AH's laptop.

I think we've all always assumed that the evidence was tampered with, has he got some evidence of this?
