I think it would be a mistake not to appeal. He has 21 days to submit. If he requests an appeal and later decides not to proceed he can withdraw it but if he does not submit he cannot do it later. I took this tweet from Greef to mean it is possible to bypass Nicol and the Appeal Court and go to the Supreme Court to request an appeal.
So his decision is not just whether to appeal but which court to appeal to.
